The Certifik8 brand, logo, interface and source code are the exclusive property of Certifik8. Any unauthorized reproduction, modification or use is prohibited. Product data displayed in passports remains the property of the respective merchants.
The Certifik8 digital passport is a digital record within the Certifik8 system. It does not constitute a legal title of ownership and cannot be used as enforceable evidence against a third party in legal proceedings.
Certifik8 provides a digital product passport service. The passport certifies the ownership record in our system and enables product traceability. It does not constitute a guarantee of the physical product's authenticity, which is the responsibility of the merchant.
Certifik8 cannot be held liable for service interruptions, data loss resulting from circumstances beyond our control, or disputes between users regarding physical ownership of goods.
Certifik8's liability shall not exceed the total amount paid by the merchant during the 6 months preceding the event giving rise to the dispute.
Certifik8 provides technical tools for issuing digital passports, sending post-purchase communications, and displaying product recommendations. Certifik8 makes no commitment to any commercial outcome, including repurchase rates, conversion rates, lead acquisition, or product resale value. Any figures mentioned on the website are industry estimates and not performance guarantees.
Certifik8 undertakes to use all reasonable means to ensure the availability and proper functioning of the platform. Certifik8 is subject to a best-effort obligation (obligation de moyens) and not an obligation of result. The service is provided "as is", without guarantee of being bug-free or uninterrupted.
Reporting a theft via Certifik8 is an informational measure internal to the platform. It has no legal value and does not substitute for filing a report with the competent authorities.
Certifik8 relies on third-party services, including the Shopify platform. In case of unavailability, modification, or interruption of these third-party services, Certifik8 cannot be held responsible for the consequences on the platform's operation.
The transfer of ownership of a digital passport via Certifik8 is a digital operation reflecting an agreement between the parties. Certifik8 does not verify the legitimacy of the underlying transaction and cannot be held responsible in case of fraudulent or disputed transfers.
Users may request the deletion of their account and data in accordance with the GDPR. Deletion results in the irreversible loss of associated digital passports.
The Smart Share temporary proof is a contextual digital indicator. It does not constitute a certification or attestation in any regulatory sense and Certifik8 cannot be held liable for any misuse by a third party.
Certifik8 provides technical tools designed to facilitate compliance with the European ESPR regulation. Certifik8 is not a certification body and does not guarantee the merchant's regulatory compliance, which remains the merchant's sole responsibility.
You may delete your account at any time from your profile. Certifik8 reserves the right to suspend or delete an account in case of violation of these terms, fraudulent activity, or abuse of the theft reporting system.
These terms are governed by French law. In case of dispute, the competent courts shall be those of Certifik8's registered office, after an attempt at amicable resolution.
